Filing of an application for the renewal of claims

This directive came into force on 1 April 2011 and was updated on 31 May 2018, to ensure concordance with the Act to amend the Mining Act (2013, chapter 32). Any previous directive on the same subject is null and void.

The directive is made pursuant to sections 61 and 207 of the Mining Act (CQLR, chapter M-13.1).

The only acceptable way to file an application for the renewal of claims with the Ministère is via the GESTIM website, using the electronic form provided for that purpose.

Signing of study or work reports required by the Act

This directive came into force on 28 November 2005 and was updated on 31 May 2018 to ensure concordance with the Regulation to amend the Regulation respecting mineral substances other than petroleum, natural gas and brine, which came into force on 31 December 2015. It makes any previous directive on the same subject null and void.

The directive is made pursuant to the provisions of Chapter VII of the Regulation respecting mineral substances other than petroleum, natural gas and brine  (CQLR, chapter M-13.1, r. 2) which, among other things, provide that:

  • The study or work report required by the Mining Act (CQLR, chapter M 13.1) must be signed by the qualified professional under whose supervision the studies or work were carried out;
  • A qualified professional is a geologist who is a member of the Ordre des géologues du Québec, an engineer who is a member of the Ordre des ingénieurs du Québec or, in the case of peat moss, an agrologist who is a member of the Order des agronomes du Québec or a holder of a bachelor’s degree in biology;
  • A qualified professional who signs a study or work report provided for in the Mining Act must also, when required to be a member of an order, enter his or her number as a member of the Ordre des géologues du Québec, the Ordre des ingénieurs du Québec or the Ordre des agronomes du Québec, or affix his or her seal to the report;
  • A study or work report that does not contain, when required, the member’s number or seal of the qualified professional and the professional’s signature will be rejected.
